This license covers all installable font formats like OpenType®, TrueType® and other in various Editions (e.g. Standard [STD], Professional [PRO] and others) for installation on several devices.
We recommend that you print this End User License Agreement for further reference.
This end user license agreement (hereinafter “Agreement” or “EULA“ or “License“) is a legal agreement between Buntype, Germany (hereinafter “Buntype” or ”Licensor”) and Licensee (hereinafter ”Licensee” or ”you”) the individual, company or organization licensing Font Software under this Agreement.
By selecting the “Accept License Agreement” button and/or downloading and/or installing the Font Software on any computer and/or use the font software and/or opening the package, you agree to be bound by the terms of this Agreement. You should read and understand the complete license agreement, before you approve. If you do not agree to the terms of this Agreement, you may not download, install or use the Font software in any way.
1. GRANT OF LICENSE
Licensor grants you a non-transferable, non-exclusive right to use the Fonts (hereinafter “Font Software”) specified in your receipt for Buntype Font Software, on a total of not more than the number of Workstations and/or users specified in your receipt for Buntype Font Software. Persons who are, or are employed by, or are members of your business or organization, who operate licensed CPUs shall be considered authorized users (hereinafter "Authorized User(s)" or "User(s)") of the Font Software.
As a best practice, a copy of the sales receipt should always be included with the Fonts. This document contain different license options. The applicable license option is specified in the applicable receipt.
1. Usage Rights
You may use the licensed fonts to create images on any surface such as computer screens, paper, web pages, photographs, movie credits, printed material, T-shirts, and other surfaces where the image is a fixed size.
You may use the licensed fonts to create EPS files or other scalable vektor-based drawings provided that such files are only used by the household or company licensing the font.
The licensee may install the Font Software on a single file server for Use on a single local area network (LAN) only when the Use of such Font Software is limited to the Workstations and printers that are part of the licensed Unit of which the server is part.
The Font Software may not be installed or used on a server that can be accessed via the Internet or other external network system (a system other than a LAN) by Workstations, which are not part of a licensed Unit. Fonts used with a server based application require a License Extension for Servers.
2. Copyright
The font and the accompanying materials are copyrighted and contain proprietary information and trade secrets belonging to Buntype. Unauthorized copying of the Product even if modified, merged, or included with other software, or of the written materials, is expressly forbidden. You may be held legally responsible for any infringement of the foundry’s intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement. In Addition, the font software contain inalienable rights of the respective Designer
3. Disclaimer and Limited Warranty
Buntype warrants the Product to be free from defects in materials and workmanship under normal use for a period of thirty (90) days from the date of delivery as shown on the respective receipt. Buntype' entire liability and your exclusive remedy as to a defective product shall be, at Buntype' option, either return of purchase price or replacement of any such product that is returned to Buntype or it’s authorized distributor with a copy of the invoice. Buntype shall have no responsibility to replace the product or refund the purchase price if failure results from accident, abuse or misapplication, or if any product is lost or damaged due to theft, fire, or negligence. Any replacement product will be warranted for thirty(90) days. This warranty gives you specific legal rights. You may have other rights, which vary from state to state.
4. Modifications
You may not modify, adapt, translate, reverse engineer, decompile, convert, disassemble or attempt to discover the source code and not to create derivative works based on the licensed Font Software itself without Buntype’s prior written consent. The Embedding bits, that indicate that the Font Software is only authorized for certain purposes may not be changed or altered. The font software may not be converted into other formats e.g. .otf to .woff or .otf to .ttf. Violators will not receive any support right and the warranty of Buntype. It constitutes a violation of this license agreement. Furthermore Buntype is despite the ban of modification actions by the licensee or a third party owner of the modified data of the Font Software.
5. Embedding Font Software and Representations of Typeface and Typographic Designs and Ornaments.
You may embed the Font Software only into an electronic document that (i) is not a Commercial Product, (ii) is distributed in a secure format that does not permit the extraction of the embedded Font Software, and (iii) in the case where a recipient of an electronic document is able to Use the Font Software for editing, only if the recipient of such document is within the Licensed Unit.
You may embed static graphic images into an electronic document, including a Commercial Product, (for example, a “gif”) with a representation of a typeface and typographic design or ornament created with the Font Software as long as such images are not used as a replacement for Font Software, i.e. as long as the representations do not correspond to individual glyphs of the Font Software and may not be individually addressed by the document to render such designs and ornaments.
6. Transfer of the font software
You may not rent, lease, loan, sublicense, give, lend, or further distribute the Font Software in whole or in part, or any copy thereof.
You may transfer all your rights to use the Font Software to another person or legal entity provided that (i) the transferee accepts and agrees to be bound by all the terms and conditions of the Agreement and (ii) you destroy all copies of the Font Software, including all copies stored in the memory of a hardware device. If you are a business or organization, you agrees that in case of a reasonable doubt with regard to the proper use of the Font Software within your organization, upon request from Buntype or its authorized representative, you will within thirty (30) days fully document and certify that use of any and all Buntype Font Software at the time of the request is in conformity with your valid licenses from Buntype.
7. Copies
You will not make copies of the Software or allow copies of the Software to be made by others, unless authorized by this License Agreement. You may make one copy of the Software for backup purposes only and you shall retain exclusive custody and control over such copy. Any copies must contain the same copyright, trademark, and other proprietary notices that appear on or in the Font Software. Upon termination of this Agreement, you must destroy the original and any copies of the Font Software
8. Termination
This Agreement is effective until terminated. This Agreement will terminate automatically without notice from Buntype if you or your authorized users fail to comply with any provision contained herein. Upon termination, you must destroy the written materials, the Product, and all copies of them, in part and in whole, including modified copies, if any.
The termination of the Agreement shall not preclude Buntype from suing you for damages of any breach of the Agreement. The Agreement may only be modified in writing signed by an authorized officer of Buntype.
9. Product Upgrades
Buntype may, from time to time, update the Product. Product upgrade pricing may apply.
10. Terms and Conditions
You have separately agreed to Buntype’s standard Terms and Conditions (http://www.buntype.com/service/terms-and-conditions-of-business) which include provisions relating to governing law and jurisdiction and export restrictions. In the case of a conflict between the Terms and Conditions and this Agreement, this Agreement shall control.
EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE PRODUCT, IS PROVIDED “AS IS”. BUNTYPE DOES NOT MAKE ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
The entire risk as to the quality and performance of the Product rests upon you. Buntype does not warrant that the functions contained in the Product will meet your requirements or that the operation of the software will be uninterrupted or error free.
BUNTYPE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT EVEN IF MYFONTS OR THE FOUNDRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
11. This License Agreement is governed by the law of the Federeal Republic of Germany. This agreement will not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is expressly excluded. If any part of this agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.
